Legal Question in Personal Injury in New York

slip and fall

I was at my dentist's office in the waiting room and I took a few steps and somehow my sneaker got stuck to their rug. It was wall to wall carpeting, and I'm not a clumsy person so I don't know how it happened but somehow I fell and fractured my elbow in 2 places and broke a bone in my arm. It was a bad injury and I just had surgery to repair it and had pins and wires put in. Should I pursue this to receive any damages?

I am sorry to hear about your accident. Your injury has value; the issue, however, is the dentist's liability. In order to make a case, you need to be able to say what caused you to fall. Your case may have merit...speak with an attorney with a practice concentration in personal injury. There are issues other than just the injuries that matter.

Without a further investigation which would reveal exactly what caused you to fall, it is difficult to fully assess your case.

I would recommend that you go back to the accident as soon as possible and take pictures of whatever defect caused you to fall.

Unless you can pinpoint the cause of your fall, establishing liability or fault on the part of the dentist is extremely difficult.

It is certainly worth investigating the case to see if there is potential liability. Do not dispose of the sneakers for any reason. you must establish fault. Your fall could have been caused by any number of defects. As everyone else has said you should consult an attorney asap.

I am sorry for your injury. But the answer to your question is, as you can guess by your popularity with the lawyers here at lawguru.com, 'yes'. You can sue. This would be covered by your dentists liability insurance.

The other lawyers have covered the ground quite well. But there is one point in which you may have an interest in choosing a lawyer: while most lawyers ask for 1/3 of the recovery, you may negotiate for a lower percentage. Especially in a personal injury case.
