Legal Question in Real Estate Law in New York

I bought a house in 2007. At closing we asked if the owner knew where the septic tank & Well were. We asked him to circle on the survey map where they were. Also if the septic tank was. He stated he did not know where it was he hasn't pumped it. I year later we found out he put in a illegal tank with no permit. Went to the town inspector he said no permit was given. The town lawyer said I should go after the owners and lawyers. My lawyer said he took a new job so he couldn't and the firm were he was wouldn't help. My realistate agent also knew it failed the inspection and didn't tell us until two weeks later after closing. The leach field is leaking all over the ground. We can't sell the house this way. Do we have a case?
