Legal Question in Real Estate Law in New York

new construction

on my contract, construction loan with extension and interest fee suppose to paid by the builder untill the house complete. but it took more than a year still not complete, my builder stop without give us any written noticed just a phone call. get someone else to finish I'm not paying any of these fee, I give you base price and some extra work w/o charge, I should not pay for it. did he breach of the contract? can we sue for the amount to complete this house with another builder?

Would need to see the contract. However, generally if a builder does not finish and you must hire a new builder to finish, the first builder is liable for the cost of 2nd builder plus other incidental expenses.
