Legal Question in Real Estate Law in New York

Engagement Ring

My ex-fiance gave me an engagement ring. I lived with him about 40% of the time and most of my possessions were in his house. I was set to move the rest of my stuff and my daughter into his house in a few weeks.

Unfortunately, we got into a disagreement and his daughter started cursing at me. When I told her the discussion was between me and her Dad, she became very verbally abusive and physically threatening.

Instead of telling her to go to her rom, he icked me out. I pleaded with him not to make me leave. I was groveling. I even called the police to see if he could kick me out of the house. They said he could do that and my ex instructed me to get my things the upcoming Tuesday.

Now he wants the ring back. Can I keep it if I want?

Re: Engagement Ring

If it was truly an engagement ring, you can not keep it.

If he gave it to you as a birthday/Christmas, etc. present, you may be able to keep it. You will need proof that it was gift.

You should know that the law is very clear on engagement rings. He is entitled to it's return.
