Legal Question in Real Estate Law in New York

Foreclousure question

Hello, I live in a home owned by my husband. We have been (not legally) separated but not divorced since 1998. My name is not listed on the mortgage nor on the deed to the property. In April of 2007 his mortgage company filed a RJI. Mortgage payments were behind about 6 months at that time. No agreement could be reached for a repayment plan and last week the court now said the case has been disposed. Does this mean the house has been foreclosed on? What is the next step that the mortgage company will likely take? I appreciate any help understanding this.

Re: Foreclousure question

You say the home is owned by your husband. Did he purchase it after you were married? If so, you should consult an attorney to determine whether or not the home is marital property ASAP.

As for disposed...that can mean a lot of things.

You should go to the court house and ask the clerk to see the file.
