Legality of living without a lease in a basement apartment

I am living in a basement apartment in manhattan. the landlord has not offered or required me to sign a lease, i have been living there for 4 months. I am behind on my rent and am wondering what the legal ramifications for me are if I do not pay my rent to him, since i have signed no contract/lease and do not even know if the apartment is legal for me to be living in?

Well before the landlord could initiate summary proceedings for your eviction, a proper notice to vacate would be required to be served on you. If the apartment is illegal then that would require the landlord to go trough a much more extensive action through the supreme court.
