Legal Question in Real Estate Law in New York

I live in a townhouse and the management has now assigned two parking spaces per unit. If you own a third car they are going to charge a $50 one time fee to park it, but they say it will not have an assigned spot nor will they guarantee that parking is available. They also plan on selling more spots then they have. Is this legal?

A townhouse generally operates its public areas pursuant to its bylaws. So long as the rule was instituted and complies with its bylaws - and does not discriminate - it should be legal.
