Legal Question in Real Estate Law in New York

If i purchased a home with a violation on the title stating finished basement (there was no C/O for the finished basement) and the town is now giving me a fine...who can i get the fine money back from? The title company's insurance? or Title Insurance Company? or the lender for allowing the mortgage with a violation on the title? I'm assuming i paid title insurance for reasons like these? How can i save myself from coming out of pocket for things that were done to the home by the previous owner in this case? Thank you

If there was a violation on the home prior to purchasing, you may be able to go after the title company. If the seller gave you a warranty deed with covenants against grantor's acts, you would be able to sue the seller.
