Legal Question in Real Estate Law in New York

signing over deed

10 years ago my husband and I signed a land contract renting with option to buy. the house has one more payment and then the deed needs to be turned over. we are not legally separated but have not been together for over 2 years. He will not sign the contract over to me even though he has not lived here. i think then he should be responsible for half of all the payments and half of the taxes and insurance i have paid on my own. What can i do?

This is a property distribution question relating to marital property.

Though no real estate has been purchased the contract to buy real estate exists.

This question can only be properly addressed by having an interview

with an experienced matrimonial attorney. There is no quick or easy way to

answer this without a full review of the assets and each person's monetary status.

The quick and dirty answer is that all monies earned and expended during the marriage

are assumed to have been done with both parties approval.

Though you paid the expenses for two of the last ten years you

both share fully in the house. There are exceptions and adjustments that

may be made to this statement but more information is needed.
