Legal Question in Wills and Trusts in New York

My mother is in hospice and I am the executor of her will. She has a very small estate of about $40,000. She has my name on her checking account as well as her savings account. She has instructed me to take the monetary value and divide it in three--1/3 going to each of her three children. Do I need a lawyer to do this? Can I just take the value and give each of my brothers their third? Thanks for your help.
