Notification of kin

To Probaate a Will is it necessary that relatives of the deceased sign off before Will canbe Probated????

The only relatives that must receive notice are those individuals that would receive property if there was no will or if the will is deemed invalid.

Although it is easier if an individual waives citation (service of the papers) and consents to the Will being offered for probate, it is not a necessary act. The individual offering the Will for probate may receive a citation and return date for the petition and serve the papers on the individual. It would then be the individual's responsibility to appear on the return date set forth in the citation in order to contest the Will.
