state in which to file will

I am a resident of New York, but own a second home in New Jersey with my brother. Can I file my will in either state?

Re: state in which to file will

After death a Will is filed (probated) in the state in which the decedent was domiciled (generally, principal residence) at the time of death.

Re: state in which to file will

You can make a will in either state, and both states would recognize the will (as long as it's validly executed) at the time of death. If you'd like help with this I can help you, I am licensed in both New Jersey and New York.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.
