Legal Question in Workers Comp in New York

4/-8 back injury

in the 90''s I worked for the Federal Government - during that time I fell in front of the building and injured my back - as a result I was out of work (on workman comp for about 3 months. I worked for the gov't for 37 yrs and 7 months. I retired in 2004. After the accident I always had back problems. After I retired I still suffered from backpain. In 12/07 I suffered chronic pack pain and had therapy, xrays, Chiropractor assistance and from the chronic I ended up takinf a MRI. The back specialist said I suffered a hairline fracture several years ago and also disc problem. I will ultimately have to have surgery.

Can I sue the Federal Gov't for this injury?

Whatever remedy you may now have(if any) for this on the job injury which you received back in the '90's would most likely have to be pursued through your original workman's compensation claim and could not now be the basis for a separate and independent action brought after all these years under the Federal Tort Claims Act (FTCA).
