Legal Question in Credit and Debt Law in North Carolina

I had a Capitol One credit card, I once had good credit but now it is bad, the card has now been wrote off. A company called Portfolio recovery associates LLc, out of Virginia.Said they bought the debt and have sent me a letter of intent to file legal action, basically when I called the number on the letter it is to a law firm in Durham NC, I was told to make payment arrangements or get sued. I did explain the situation, that I am on disability at the moment and not sure when I will get to go back to work. They said that they did not care if I was homeless or dying that I had to pay the bill. I thought that once a debt was charged off they no other action could be taken...please help I can not pay this, nor do I want to be sued. HELP..what can I do...is this legal???

Yes it is legal. However, there may be other defenses such as statute of limitations. Consult with an attorney or legal aid to understand all your rights and possible defenses.
