Legal Question in Credit and Debt Law in North Carolina

I filed chapter 7.bankruptcy 3 years 2 months ago. Now.i am.in debt over my head once again i.tried.to.do.a.debt relief program but they wanted way more then i.could.afford and said.they couldnt.help.me i cant file.chapter 13 for.10 months or so. Is there anything i can do ? I am.so.overwhelmed and ashamed that i got myself into this again. All.of.the debt is.unsecured loans and.creditcards. I need help..

You can hire an attorney to keep the collectors at bay for now, and make a plan of action. You actually could file a Chapter 13 now which would stop collections, you just won't be able to get a discharge. It may or may not be necessary to file a Chapter 13 when you can file one and get a discharge. This depends upon what your asset situation looks like and what your long term goals are. I suggest you consult with an attorney who handles both defending from debt collectors in court and filing for bankruptcy. That way, you won't have to go to a second attorney if you need a lawyer to defend a debt collection lawsuit or if filing for bankruptcy ends up being in your best interest several months from now. Once you are represented by an attorney and either original creditors or collection agencies are informed, the phone calls have to stop or you have claims against them for unfair debt collection practices. There are numerous attorneys in your area who can handle this for you from now through bankruptcy if that ends up being necessary.
