The first step toward a divorce is to physically separate (not live in the house) and for at least one of you to form the opinion not to resume the marital relationship. After one year of separation you may then begin the formal process of filing for divorce. In the mean time, you can resolve all other marital issues such as child custody, support, equitable distribution etc. through what is known as a Separation and Property Settlement Agreement. Our firm can draft this for you for a flat rate fee of $250..
