Legal Question in Family Law in North Carolina

My husband and I are separated. The car I drive is in his name but I have made the payments each month since June 2014, before we were married May 2014, he traded in my car for this one Iam driving now. I have proof thru the bank that I hhave made the payments on time and will continue to do so. He has not made a single payment. So he has told me that the car is his. This is in the State of North Carolina

So I am assuming you are wondering if that is true. Well if so, wonder no more because it is TRUE! Of course, you have a marital interest in the car so if you and your husband can not come to an agreement about who should get the car an uder what terms - you can have the Court make that decision for you. But basically, as things stand now he can take the car if he wants as long as he doesn't breach the peace to do it. So what you need to do is keep it in a locked garage and / or invest in one of those 'club' anti-theft devices (do they even still make those things). Anyhoo, best of luck to you!
