Legal Question in Family Law in North Carolina

I was involved with a married man in the state of North Carolina. The Wife has not threatened to sue me and get me fired IF I do not leave the husband alone. The husband is now separated from the wife with no intentions of mediation of the marriage. If the wife sues me for alienation of affection or criminal conversation can I counter sue for Blackmail being as though she stated she would not sue or come after my job provided I stop seeing the married man.

What you have described is likely not blackmail. The wife merely made you an offer to not sue or take other legal action(s) against you in exchange for you staying away from her husband. Blackmail is when you demand money or other property from someone in exchange for not revealing some sort of information about that person. Further, even if what she did were to be considered blackmail, in NC blackmail is a crime, not something you sue civilly for. So the short answer is no, you likely can not counter-sue for blackmail. However, you may have other options. It is likely best to take a wait and see attitude. If you are served with a law suit you will have plenty of time to consult with an attorney and come up with a game plan - no real need to let this worry you too much now. Best of luck.
