Legal Question in Family Law in North Carolina

I would like to do a minor name change for my daughter. She is 5 years old and has my ex husband's last name. My ex husband is not her biological father. Her biological father is not listed on her birth certificate, however a paternity test was filed. He is unwilling to sign any documents to change her name unless I let him give up all paternal rights to her so that he no longer has to pay child support.

That sounds fair - he shouldn't be paying child support anyway. If you are saying you want to change your daughter's last name and still keep your ex-husband on the hook for child support even though you know he is not the father - then I really can't blame him for not wanting to consent to the name change.
