Legal Question in Family Law in North Carolina

My son has never had a relationship with his biological father. Him nor his older sisters have spoken to him in over 5 years even though he leaves 10im away. My son wants to change his last name to his step dad who has been here since he was 2. He is now 11 and this has been all his decision no pressure or influence from us. Other than he pays support bc it's garnished how likely would it be for a judge to grant the change

Not likely unless father consents. Especially if you present inconsistent facts as you have done in your question. You state the child has "never had a relationship with his biological father" which appears to be untrue because you - then you state "have[n't] spoken to him in over 5 years". If you do petition for a name change stick to the facts of "have[n't] spoken to him in over 5 years" Of course when the child turns 18 he can change his name to pretty much whatever he wants or even better have step-dad adopt him.
