Legal Question in Civil Litigation in North Carolina

My fianc� bought a car but has no license. She had my name put on the title under her's. I had it registered and insured under my name because I have a license. She refuses to allow me to drive

it to go to work and wants to hide the keys.

Can she do that?

Let me get this straight - Your fianc�e can buy a car, but she cannot insure it because she is not licensed. She thus cannot drive it. Nevertheless, she sticks your name on it so she can get it insured, but she will not permit you to drive it. So why did she a buy the car in the first place? So she can look at it? I am not sure what she is doing here. Are you sure that you want to marry this girl?

She cannot have her cake and eat it too. By putting your name on the car, she made a gift of one-half the value of the car to you. That means the car is half yours. Make a duplicate set of keys and use the car when you want or bring a partition action and have the car value apportioned between the two of you.

Or, you can be decent. Tell her that the car can just be in her name and she can park it and admire it but not insure or drive it or have your name on it. I would offer to sign it back over to her but make it clear that you are leaving and will not marry her. Or she can decide to let you go to work. After all, you are going to be married and a wife would want to share things with her husband, right? Its your call.

Personally, I don't like what this girl is doing. She is using you so she can get insurance on the car and is trying to commit a fraud. I would leave her and make her put the car in her name before you go.
