Legal Question in Personal Injury in North Carolina

auto accident

My mom and two sisters and daughter were rear ended while sitting still to turn in church for mothers twin brothers funeral I have been taking her to her chiro and PT appointments as she doesn't drive. I have to get off work and go pick her up etc. Can I be compensated for mileage and loss work time-at what rate? Mom paid for MRI for back out of pocket because their insurance said it was to minor of an accident to need one so he wouldn't agree with the chiro to send her. Can she be reimbursed when she settles even though he didn't agree and it showed nothing definitive. My daughter had to have a CT scan about two weeks later for severe headache which she never had before-just since accident. Also did a spinal tap to make sure no hemorrage in brain-shouldn't the insurance be responsible for this. I am worried he will argue about paying for this.

Please remember that it is very difficult to give full advice on limited information, and by e-mail. As is the case many times under the law, there is not necessarily a clear answer. Cases like this cases be very fact specific and further information may be helpful.

Basically, the insurance company is challanging the reasonableness of the medical treatment relative to the severity of the wreck. You may actually benefit from a consultation with a lawyer.

We do recommend keeping track of milage to medical provides and any transportation cost. You would not be entitled to time off per se, but may be entitled to the reason cost if such assistance is necessary.
