Legal Question in Personal Injury in North Carolina

Daughters bicycle injury

I live in a new community and there is a lot af construction. There is a lot of sand and gravel in the street. My daughter was riding her bike, slipped on the debris and broke her toe.

Medical bills will be small, probably no permanent damage.

Can I put a lawsuit against the builder for neglicence.

Thanks,

Bill

Re: Daughters bicycle injury

Thank you for your question.

Please remember that it is very difficult to give full advice on limited information, and by e-mail. As is the case many times under the law, there is not necessarily a clear answer. Cases like this cases be very fact specific and further information may be helpful.

This would seem like a situation that could be concluded short of a lawsuit. I would suggest first talking with the builder or contractor. You may also want to contact the local building inspectors office regarding any possible local ordinance violations.

Thank you again, and please feel free to contact us if we can provide further information.

Best Wishes,

David D. Daggett
