Legal Question in Traffic Law in North Carolina

Very unhappy with lawyer, now what?

I had a very very old traffic ticket (driving while suspended for an unpaid previous ticket offense date 10/2001). I never responded to the ticket and now 6 years later I finally was taking care of all outstanding tickets and this was the last thing I had to get taken care of. The offense took place about 60 miles away in another county so I looked online and found an attorney and called and explained my situation to her. She said she could represent me in the matter and got the case put on the docket. She then went to court on my behalf and just pled me guilty to a DWLR and got a Prayer for judgement. She didn't reduce the ticket to No Operators license or anything. I'm very dissapointed with this because now that I have a license my fiancee put me onto her insurance. Initially when we called to add me to the policy we were told there would be no change in the premium. Well, now 2 months later we get a letter from the insurance company saying her insurance has gone up $600! She had one PJC for 44 in a 35 zone. So now I've called another lawyer and he is asking why my lawyer didn't get a Nunc pro tunc which would have kept it from a violation in the last 3 years. What can I do from here?I have not had any tickets in the last 5 yrs

Re: Very unhappy with lawyer, now what?

It is very hard to say what a lawyer should have done - it really depends on the county. Maybe they did not want to nunc pro tunc it.

I honestly would never have recommended that your wife get a PJC on a 44 in a 35. That is a waste of PJC if it was her only ticket. A 44 in a 35 would not have had insurance consequences. What you may want to do is make a motion for appropriate relief on your wife's ticket and have the PJC removed from your wife's record.
