answer to an appeal

i heard it usually takes 90 days or sooner for an appeal decision, what would the reasons be to take longer than that? I checked other cases on same day and they have been decided weeks if not 2 months ago? thanks

I do not agree that most appeals are decided within 90 days. My experience is that appeals often take more than 90 days between argument and when decision is released.

This results from many factors. Perhaps one of the judge's on the three-judge panel is not persuaded, and the other two are trying to modify the opinion so that they all agree. Perhaps the judge assigned to write the opinion is backed up. Perhaps the three judges cannot reach a consensus because no two of them are willing to adopt the same legal reasoning.

I always tell people that it typically takes between 6 to 12 months before an appeal decision is reached -- and that is merely an estimate. There is no time limit.
