Legal Question in Criminal Law in Ohio

The cops called me about a teaft I was accused of by my old work. They are not pressing charges on me but the DA still may. I was just wanting to know if I go in to the police and give a statement can I be arrested ? The cop that called me sayed he would not arrest me but wanted to read me my rights and fill out a statement then I was free to go. Is it a lie just to get me there?

While it is technically possible that you could be arrested, it is unlikely. Normally what will happen is that the officer will take the information that you provide and if he thinks he has enough against you for a good case, he will forward it to the prosecutor's office. The prosecutor who receives the information will ultimately decide whether to file charges or not. You may or may not be arrested at that time. This process could take anywhere from days to months.

The best way to avoid being arrested in the first place is to not speak to the police. Especially if you are potentially looking at a felony charge (a more serious charge than misdemeanor theft), you will want to find an attorney to make sure you are protected as much as possible. My general advice is to not speak with the police, but whatever attorney you choose can talk to you about the advantages and disadvantages of going to make a statement.
