Legal Question in Criminal Law in Ohio

felony investigation

I am under investigation for felony theft charges from my former company. I did fill out a addmission of the charges against me. I am currently free, but will be receiving notice in the mail of pending court dates. Do I need a lawyer present with me? I have no criminal record and have to avoid jail time. I am currently seeking employment in order to pay restitution to my former company. Is probationa possibility? What should I do?

The short answer is yes, you should probably get a lawyer to help represent you. The prosecutor is much more likely to discuss the case with an attorney than with a defendant and offer a plea deal. The prosecutor will usually allow an attorney to see the entire file, make copies of any documents the attorney might want, and in general give more attention to an attorney than a self-represented defendant. It may not seem fair, but that is the unfortunate reality of the system.

You don't *need* have a lawyer. But it really is to your advantage to have one, especially in your situation since you are looking to avoid jail time but have already filled out an admission.

You definetly need a lawyer. A lawyer will be able to discuss options with you which may not be obvious.... these include resolutions which won't affect future employment, no jail time, the possibility of having your record sealed, etc.
