Re: Look Back periods

An OVI charge, even a first offense, carries a potential of 180 days in jail, a potential fine of $1,000.00, and a potential drivers rights suspension of up to 5 years (as a condition of probation).

A first offense OVI (high test) carries a mandatory six days in jail or three days in an alcohol program and three days in jail.

Thus, on a first offense (high test) the judge has the discretion to sentence between 6 days and 180 days. One factor that might influence a judge to sentence above the minimum is if the defendant had prior alcohol related offenses. That is how the issue of the 1987 and 1995 cases could hurt you.

If you blew a .20, you should have an attorney represent you.
