my step-daughter was in an accident with a possable of dui and the person in the car died what is she looking at this is her 1st dui

It really depends. Typically, first time DUI offenders will be given the minimum sentence which requires 3 days in jail (substituted for a 3 day alcohol treatment program) and fines which could range upwards to 1000 dollars. If someone was killed, it obviously could be a lot worse. Without knowing the particulars, I would not be able to tell you. Assuming your step-daughter was not under suspension at the time of the accident, if the death of the other person was the result of a DUI, she could br sentenced to up to eight years in prison. If she was under suspension at the time, she could get up to ten years. When you say there was a possibility of DUI, what do you mean?

Whether or not this is her first offense, she is looking at mandatory prison time. Did she perform the breathalyzer? What was the reading?
