Guardianship while mom is married??

My mother had a brain aneurysm in 2005, she lost her job, and was about to lose her health insurance when she married her ''boyfriend''. Before the ''marriage'' he took her to lawyer for prenup. Lawyer told her she would not need one, if they divorced what she had before marriage would be hers after marriage. (house) Now mom diagnosed with stage III lung cancer. This marriage was a ''business arrangement'' so mom could have health insurance & boyfriend had a place to live. Now I am finding out BF has drained moms investments and savings, and is trying to get her to change beneficiaries on all her life ins. and remaining investments. Could I get guardianship over mom, even though she is ''married''??

First, it would have to be determined that she cannot managed her own affairs. If so, it is possible that you be the one appointed to manage her affairs.
