Legal Question in Family Law in Ohio

my exwife and I divorced 3 yrs ago, In our divorce papers it states she could not afford to put the truck in her name so it was to stay in both our names. However she did get the truck and the payments, she was to keep up the payments. She has not done so and has been at least 1 payment late every month. This is effecting my credit. Can I take her back to court in contempt in not fulfilling her duty? Also she is the Clerk of Court!

More than likely, yes, you can file a contempt motion. However, I would have to review the actual language of the divorce decree first.

Given your ex-wife's position with the court, it may be necessary to ask for a independent judge or magistrate, or even a change of venue.

Should you have any quesitons, please do not hesitate to call or email. 614.481.3737; [email protected]
