Where do I file for custody?

My ex-husband lives in Ohio with our two daughters, he has been there roughly 6 months. Prior to that he lived in Florida with them for around a year. The last residence we shared together with the kids was in Virginia, that is also where our divorce was final and where the current child custody arrangement is. I am wanting to file for full custody of my girls but I do not know where to do so. I was told by an attorney here in Virginia that if I file here it may get moved to the state that he resides in. What do I do?

Virginia is the only state with custody jurisdiction, and is unlikely to give it up.

You should start in Virginia where custody originates. Their father may request the court to move the matter to Ohio.
