grandparents/joint custody

MY daughter has a very seewt son (my grandson) by a guy who doesn't work or have to pay child support. He sees my grandson when it's convient for him. My daughter is about to be homeless, has lost her job, and lives with a guy who is lazy and wont do anything to help her out. He has a child too but she lives her mother. My daughter trys to be a good mother but she is very overwhelmed with all the responseibility of of playing '' house ''. She has made some very BAD dessions when it comes to my grandson. The childs father receives SSDI for disability and has a seizure disorder.... This why he says he can't work... Even tho he does under the table. I am very concerned about my grandson and want to know if there has ever been a case where the parent(s)(we live in the same town, except the father stays between his grandparents and friends houses...this isn't good for the child either) and grand parents have shared legal custody? Is it neglect when a mother leaves her 22 month old son home alone in bed with the neighbor watching him on a baby monator? I am very upset about this and want to take custody or shared custody but I am afraid my grandson will be put in the system and I will never see him again. And I love him very much !!!!!!

You should file a motion to obtain legal custody. I have done this many times and am usually sucessful at keeping Children Services out of the case (therefore no worry about losing custody to the state). Shared custody is not an option. However, you would have the discretion to grant the mother visitation as you see fit. I could also get a support order put on for the father. Feel free to contact me for a free consultation.
