Legal Question in Family Law in Ohio

My husband and I have been separated for about a month. No paperwork has been filed, we just aren't living together. Before we split we had talked about moving to Florida and I would still like to move down there. Am I able to do this and take our 5 month old son with me? Also once I'm down there am I able to file for divorce down there as that will be my place of residence, or do I have to file in Ohio before I move since I have lived here my whole life?

Since there are no court orders in effect now you can move anywhere you want. To file for divorce in Florida you would have to meet their residency requirements. I am not licensed in Florida so I do not know what they are. If you leave your husband can file for divorce in Ohio at anytime. Once you have established residence in Florida you can file there, however if he filed in Ohio and had you served, Ohio would hear the divorce.
