Legal Question in Family Law in Ohio

my kid's mother is threatening to call the police if I come near her house and also won't let me see my kids. if I were to take my kids would she be able to press kidnapping charges on me? my kids have my last name but we do not have any legal custody agreements. I just want to spend a day with them and send them back home, not completely take them from her.

In Ohio, until you have been adjudicated as the children's father by a court (usually the juvenile court if you were not married at the time the children were born) then you would likely have a lot of trouble seeing your kids without the mother's permission.

You need to file a case to determine paternity, and then the court will set up a visitation schedule with your children which your wife must honor or she will be in contempt of court.
