Marital Settlement Agreement - 1st Step?

My husband and I have been married for 31 years; his earnings are about 8 times mine (I stayed home with the kids, entertained for him, took care of the house, etc.) He is talking about spliting up, and while I'm in an emotional upheaval, I would like to come to terms with my financial future.

If we write up our own marital settlement agreement (perhaps using one of the books or kits available), does that constitute a contract? What would it take to make it one, and have it hold up in court if necessary - witnesses, legal language, being notarized?

Yes, completing one of those "do it yourself" kits very well would constitute a legal, binding contract. The kit will contain all the instructions on how to make it legal.
