Move with child before divorce

My husband has had an affair with the neighbor for a year. We have not filed for a divorce yet, but do live seperatly. He moves in and out of mine and her houses. Can I move our son to Columbus, OH without his permission.(where I have family support) Can he make me move back? (if & when he files) How can I get a temporary custody order in place without filing for a divorce?

Prior to the filing of a divorce each parent has equal rights to the child. Therefore you can move your child to Columbus. If you wnated to file something in the Franklin County Courts you can file for legal separation until you have lived in Franklin County the requisite time period to file for divorce.
