My husband was on med. leave and when he got back to work he was told he had no vacation days left. aAre they allowed to take your vacation away? He was out for 6 days.vacation starts in July

Employers covered by the FMLA (i.e., employers having 50 or more employees) are permitted to require that FMLA and accrued vacation and sick time run concurrently. However, if the accrued time off is �paid� time off (e.g., paid vacation), then the employer is required to provide advance notice to the employee that accrued paid leave will be substituted for unpaid leave. If the employer does not make that designation or the employee does not choose that option, then the employee is entitled to all the paid leave which he/she has accrued.
