Legal Question in Civil Litigation in Ohio

Compensation

I worked for a company called VRI. They supply the monitors for your home that if needed, you push the button for assistance. Shortly before I left employment, I was asked by Lynn to assist with creating an audio demo for training purposes. I agreed and with Lynn Kercher and Bob Morris created an audio demo tape. I left employment on 11/29/05 due to managerial changes. Approximately a month ago, a former employee informed me the audio tape I helped create during my employment is now on VRI's website as a selling tool to promote their units. It has been on their site since shortly before I left VRI. I contacted Mr. Darren Torrence this past week and asked the tape be removed since it was not created to promote their product. He replied today that he owns the tape and no compensation will be forthcoming. How can he use my voice on a tape that I did not give my permission to use as a selling tool?

Re: Compensation

Good question. It may be a copy right question. If there was any conversation and/or understanding of what the audio tape would or would not be used for, you may have a right to have it removed and/or be compensated for its use. I recommend calling a lawyer to investigate.
