Dissatisfied with my Attorney

I had retain an attorney for an automobile accident in 2004 that I and my 19 year old daughter were in. The accident occurred in April, 2003. She told us to wait before we filed even after I kept telling her the time was running out. She was aware of the deadline, but in her lateness she filed two days before the deadline and left my daughter's name off the paperwork. She was hurt and had surgery to her knee. Needless to say her case was dismissed. This lawyer tried creative tactic to recover but it did not work. Since she has had my case dismissed w/o prejudice and stil have not settled. I am not satisfied and want to fire her. Can I do that w/o reprocussion since she dismissed the case and did not tell me?

Yes, you can fire her. A dismissal without prejudice does not preclude you from having your suit re-filed. It must be filed, however, within one year of the dismissal.... with minor exceptions.
