Legal Question in Insurance Law in Ohio

Insurance Liability

short as possible...a friend came to my house and my sister and I went out with him...he asked my sister to drive his truck and handed her the keys...she did...at the end of the night we got into a wreck...I suffered 200 stitches to my facial area. The truck was in his father's company name and the company had many claims and was in fear of losing their insurance again due to this accident...so the father decided to say that he did not give the son permission thus not covering me in the accident. Furthermore, the son did not have a driver's license and was excluded from the existing insurance policy...which I found out later. The son worked for the father and used the truck as his own (for work and personal use) and presented it as his own...I have known the family for 17 years and I am in awe about the lie...My question is what can I do? Do you know of any cases that I can look at that may help support my case???

Thanks for your time,

Re: Insurance Liability

You will likely need to sue not only the driver, but the son and the vehicle owner to recover your losses. Gather witnesses regarding the son and his possession and use of the truck. Talk to the son about what his testimony will be. Was a police report filed about the truck being "stolen"? A good attorney should be able to shoot enough holes in the story of the father to get coverage for your loss. You may also have coverage under your insurance policy for this loss. Check with your agent. Call me with any questions. 859-491-5800. Best of luck.
