Legal Question in Personal Injury in Ohio

nursing home abuse

my brother was placed in a nursing home in wv.after suffering a ruptured brain aneuryism.he has dementia.that was 6 yrs.ago.his girlfriend whom he resided with had convinced his doctor to name her his medical surrogate. for some unknown reason, that his girlfriend would not disclose to the family,he was transferred to a nursing home in ohio.she would not tell us where he was. by the time that i found out where he was, which was 3 years later,i went to see him.he was blind in one eye.i don't know how this happened.he had been in his 3rd.nursing home in ohio by the time i found him{i listed him on a missing persons website} i finally got him moved back to wv and am now attempting to get guardionship over him.then i plan to backtrack each place he was at to find out how he lost his eye.his medical records also has been fabricated showing his disability resulted from an altercation.i have his medical records when he became disabled proving he became disabled from a brain aneuryism.when i track down where he got injured, can i still pursue a case against whoever is responsible even though it may have happened 4 years ago?

Re: nursing home abuse

Perhaps. The statute of limitations for tort claims is suspended while a person is under a disability. You must consult a lawyer to evaluate the facts.
