Legal Question in Social Security Law in Ohio

Retroactive Social Security Disability Payments

In 1985 I applied for SS disability because of my heart condition and other medical problems and was turned down because they said I did not have enough credits, which I did. I applied four more times. In July 1999 I received disability. I was paid for four years. The ALJ read " It is the decision of the ALJ that, the claimant is entitled to a Period of Disability commencing April 15, 1985 and to Disability insurance Benefits under Sections 216(i) and 223 respectively, of the Social Security Act. Shouldn't I have been paid back to 1985? SS made a mistake on my credits. I had the credits and the medical proof I was disabled. I was not able to work again. Each time the only reason they gave for not approving my claim was I did not have the credits. Thank You -

Re: Retroactive Social Security Disability Payments

It would depend upon whether you kept your claim "alive" during the entire process.Your claim begins on the date it is filed, and if you allowed a claim to expire during on of the 4 time periods that you were filing claims, your claim might only go back 4 years. It's difficult for me to be precise without looking at your claim history. If you are due back benefits, try to find a lawyer in your area who handles these claims.
