Legal Question in Traffic Law in Ohio

Jury Trial

Is there any situation in which a jury trial might be held for a traffic offense not involving personal injury? Would personal injury make a jury trial possible?''Mahoning Valley Stonewall Democrats''

Re: Jury Trial

In Ohio, you have the right to a jury trial for any offense that is an M4 or above - which is another way of saying any offense that creates the possibility of jail time. Some offenses that qualify are OVI (DUI), driving under suspension, or multiple offenses within a certain time period. Most of your other traffic offenses, such as speeding, turn signals, and assured clear distance (ACDA) will normally be minor misdemeanors and therefore not eligible for a jury trial.

Generally, the presence of personal injury will not affect the traffic offense charged. The presence of personal injury can open you up to civil liability (as can property damage) however, and in a traffic case that is normally the greater concern.
