Legal Question in Wills and Trusts in Ohio

Is it possible that my father has a second updated version of his will that is b

My father recently passed away.He had a wife that wasn't my mother. Befor he died he said that he was ''getting things straightened out with his lawyer'', to me that ment he was updating his will. my brother recently obtained a copy of the will from the lawyer and it was last updated in 1996. Is there any way to find out if there is an updated version of the will? My brothers were left things in the will that are no longer in posession of my fathers estate, this is what leads me to believe there is an update to the will and my dads wife and the lawyer have some kind of crooked sceme cooked up. Please help me!!!

You can call the lawyer you think may have drafted the Will and ask or at least give the lawyer your current address if he/she has to notify you. They probably won't give you any information. You can monitor the filings in probate court to see if a will is filed and get a copy of it. Many probate courts are on-line with enough information to know if a will has been filed and who the Executor is.

I frequently encounter situations where the deceased person fails to update his Will even though circumstances have changed or property has been given away. Therefore, it is quite likely that he did not update his Will. There are really only two places for you to check. First, you should call the Probate Court and ask whether your father deposited a Will there during his lifetime. Second, you should ask your father's attorney if a new Will was created (your probably did this already). Otherwise, there is no other way to find out if he updated his Will except going through his personal papers.
