Legal Question in Wills and Trusts in Ohio

where to file

My stepfather died in June.They lived in florida but i brought them here before he died. My mother is in a nursing home in ohio now. I am selling the home in florida.My stepfather named me execotor of his will. Do I file in Florida or Ohio. Also how do I begin that process. He actually did not leave any money or property. Do we even have to probate ?

If your step-father became a resident of Ohio prior to his death, you would file the will in the County where he resided. His residency depends on his intent and other factors. Whether you have to file or not will depend if he had any assets just in his name with no named beneficiary. If you open the estate in Florida and the Florida property is just in his name, you will need ancillary administration in Florida. Call or email me if you have follow-up questions.
