Legal Question in Workers Comp in Ohio

How much and when can we get a settlement?

My husband was injured about 8yrs ago in a work related accident (broken foot, shattered heal, tendon ripped, 12inches of nerve damage) He has gone thru 3 surgeries over this time and has been told this is pretty much all they can do. he has been determined 15% permanently disabled. We have an attorney however I feel they have put us way on the back burner and many areas have been incompentant. My Q is, CAN my husband file something for a settlement with BWC? How much would you think is appropriate to ask for? Is it too late? We have asked our attorney this and they said would look into it however we have not heard back from them and haven't returned our phone calls in over 3 months. suggestions PLEASE. Thank You!

You do realize that your attorney can only work as fast as the BWC right? BWC may be overworked or have some other delay preventing them from quickly responding to your offer. While your attorney should be returning your phone calls or at least providing you with update letters, I would imagine the delay is with the BWC.
