Legal Question in Criminal Law in Oklahoma

conviction

My brother signed a plea agreement for 5yrs with time served which left him with 22mo to serve. Once he made it to Lexington to be processed in, his sentence changed to 5yrs flat with his time starting on the 7th even though he has been sentenced and sitting in jail since May. What do we(family) need to do to help get this issue taken care of? The attorney he had is disbarred now so he can't help us.

It is alway important to make sure the sentence the judge handed down is administered properly by DOC. There are several recent cases that have dealt with the manner in which DOC administers sentences and DOC has its own written policy. If they are not following either of there he can request a review from his case manager or grieve the issue all the way to the DOC director. You should contact an attorney that is knowledgeable with DOC and their procedures to advise you. If I can be of assistance, let me know.
