Legal Question in Insurance Law in Oklahoma

Filing electronic medical claims in a Timely Fashion....

Payment of Insurance Claims in a Timely Fashion.....

My husband and I are covered by a Health Insurancy Company in Owasso, Oklahoma. Our Insurance Medical filing is very, very slow in paying out claims....some claims have taken over one year to pay out. We do not have ''Pre-existing clauses'' in our Insurance coverage, but since some of our claims were not paid out within a period of 3 months- we have been turned over to a Collection Agency. We refuse to pay these bills- since our Insurance owes the payment- since we have meet the co-payment and all applicable deductables!

Do I have a right to file a HIPAA Claim against the doctor's office and our Insurance Carrier for not paying out these claims in a timely fashion?

We have had several bills outstanding- due to our Insurance Carrier refusing to pay the bills.

What can we do to get our Insurance to pay out correctly in a timely fashion? And do we have a right to file with the Insurance Commissioner in the State of Oklahoma-since sometimes it has taken one year to pay out our claims?

Hire an erisa lawyer and sue the insurance company. You can complain but how will that get your bill paid? Why complain about the doctor?
