Legal Question in Employment Law in Oklahoma

Vacation pay dispute

After being terminated from my job, was informed that I was not entitled to my vacation pay. I was there for three years and five months and had earned two weeks paid vacation and had only used one week. He stated that as a salaried employee I did not get vacation, but the employee hand book states that all employees after two years recieve two weeks paid vacation. there was no verbal statement on the subject during my term of employement there and no seperate rules for hourly and salaried employees on this subject. can I claim the time?

Re: Vacation pay dispute

Yes. You are covered by the Protection of Labor Act in Oklahoma... if they have a policy to pay all employees vacation time, then they must pay all employees per its own emploment manual... if there are no differences set forth in the policy manual, then verbal changes do not override written policies; therefore no difference as to whether the employees are salaried or hourly.
